1. Agreement to Terms
By accessing and using TendarCare's platform and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access or use our services.
These terms constitute a legally binding agreement between you and TendarCare Health Services (referred to as "TendarCare," "we," "us," or "our"). These terms apply to all users of the platform, including patients, caregivers, and visitors.
2. Definitions
- "Platform" refers to the TendarCare website, mobile applications, and all related services.
- "Patient" refers to individuals seeking or receiving home healthcare services.
- "Caregiver" refers to healthcare professionals providing services through our platform.
- "Services" refers to home healthcare services facilitated through our platform.
- "Escrow" refers to our secure payment holding system.
3. User Accounts
3.1 Account Registration
To access certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
3.3 Account Types
- Patient Accounts: For individuals seeking home healthcare services
- Caregiver Accounts: For verified healthcare professionals providing services
- Admin Accounts: For platform administrators and support staff
4. Caregiver Verification
All caregivers on our platform undergo a comprehensive verification process, including:
- Background checks and criminal record verification
- Professional certification and license verification
- Skills assessment and training evaluation
- Reference checks from previous employers
While we take extensive measures to verify caregivers, TendarCare does not guarantee the conduct or competence of any caregiver. We encourage patients to review caregiver profiles, ratings, and reviews before booking services.
5. Service Booking and Payment
5.1 Booking Process
Patients can book services through our platform by selecting the desired service type, duration, and location. Upon booking, patients will receive a unique request ID for tracking purposes.
5.2 Escrow Payment System
All payments are processed through our secure escrow system. When you book a service:
- Payment is authorized and held in escrow
- Funds remain in escrow until service completion is verified
- Upon successful verification, payment is released to the caregiver
- Revenue is split according to our agreed terms (e.g., 70% caregiver, 30% platform)
5.3 Payment Methods
We accept payments through our integrated payment gateways (Paystack/Flutterwave). All payment information is processed securely and is not stored on our servers.
5.4 Pricing and Fees
Service prices are displayed upfront during the booking process. The platform charges a service fee, which is included in the total price. Prices may vary based on service type, duration, location, and caregiver qualifications.
6. Service Verification
Upon service completion, patients must provide a unique 4-digit verification code to the caregiver. This code is generated through the patient's dashboard and serves as confirmation that the service was completed satisfactorily.
Once the caregiver enters the correct verification code, payment is automatically released from escrow. If there are issues with the verification code, patients should contact our support team immediately.
7. Cancellations and Refunds
7.1 Patient Cancellations
- Cancellations made 24+ hours before service: Full refund
- Cancellations made 12-24 hours before service: 50% refund
- Cancellations made less than 12 hours before service: No refund
7.2 Caregiver Cancellations
If a caregiver cancels a confirmed booking, patients will receive a full refund and we will assist in finding an alternative caregiver when possible.
8. Digital Prescriptions
Caregivers with appropriate credentials may issue digital prescriptions through our platform. These prescriptions are:
- Securely stored and encrypted
- Accessible only to the patient and authorized healthcare providers
- Available for download and printing
- Linked to specific service requests for tracking purposes
Patients are responsible for verifying prescription details and consulting with their primary healthcare provider regarding any concerns.
9. User Conduct
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit harmful or malicious code
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Attempt to circumvent our payment or verification systems
- Use the platform for any illegal or unauthorized purpose
- Engage in any activity that disrupts or interferes with the platform
10. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using our platform, you consent to the collection and use of your information as described in our Privacy Policy.
We implement industry-standard security measures to protect your personal and medical information. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
11. Limitation of Liability
TendarCare acts as a platform connecting patients with independent healthcare professionals. We do not provide medical services directly. To the fullest extent permitted by law:
- We are not responsible for the quality, safety, or legality of services provided by caregivers
- We are not liable for any injuries, damages, or losses arising from services provided through our platform
- We make no warranties regarding the availability, reliability, or accuracy of our platform
- Our total liability shall not exceed the amount paid by you for the specific service in question
12. Indemnification
You agree to indemnify and hold harmless TendarCare, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, violation of these terms, or infringement of any rights of another.
13. Dispute Resolution
13.1 Between Users
Disputes between patients and caregivers should first be reported through our platform. Our support team will review the case and facilitate resolution when possible.
13.2 Arbitration
Any disputes arising from these terms or your use of our platform shall be resolved through binding arbitration in accordance with Nigerian law, except where prohibited by law.
14. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe:
- Violates these terms or our policies
- Harms other users or the platform
- Exposes us or other users to legal liability
- Is fraudulent or illegal
Upon termination, your right to use the platform will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
15. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through a notice on our platform. Your continued use of the platform after such modifications constitutes your acceptance of the updated terms.

16. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
